Terms of Service
The short version
- DevQux is a service for businesses. Your account is yours to keep secure; your workspace is yours to manage.
- What you put in your workspace stays yours. We use it only to run the Service for you.
- Paid plans renew until cancelled, and every plan has the limits it describes.
- The assistant can be wrong. Check what it tells you before you rely on it.
- We may change the Service and these Terms; material changes come with notice.
1. Who we are and this agreement
DevQux is operated by [Legal entity name] (“DevQux”, “we”, “us”), of [Registered address]. These Terms of Service (“Terms”) are an agreement between you and us about your use of the DevQux website, accounts, workspaces, assistant and programmatic interfaces (together, the “Service”).
By creating an account you confirm you have read and agree to these Terms and our Privacy Policy. If you use the Service for an organisation, you agree for that organisation and confirm you may bind it.
You must be at least 18 years old to use the Service.
2. Your account
Give us accurate information, keep your password and sign-in methods secure, and tell us at [Legal and privacy contact email] if you think someone else has used your account. You are responsible for what happens under your account. One account is for one person; do not share it.
You can see every device signed in to your account, and sign the others out, from your account settings.
3. Workspaces and your content
The Service is organised into workspaces. Whoever creates a workspace is its owner and decides who else may join it and what each member may do. Owners are responsible for the people they invite.
What you and your members put into a workspace (“Your Content”) remains yours. You give us the permission we need to host, process, transmit and display Your Content to provide the Service to you, and for no other purpose. You confirm you have the rights to the content you put in, and that doing so does not break any law or anyone else's rights.
4. Acceptable use
Do not use the Service to break the law or to harm anyone. In particular, do not:
- access another workspace, account or system you have not been given access to, or probe, scan or test the Service's security without our written permission;
- interfere with the Service or place an unreasonable load on it, including by automated means beyond the limits we document;
- upload malware, or content that is unlawful or infringes someone else's rights;
- resell, sublicense or provide the Service to third parties, unless we have agreed to it in writing; or
- use the Service to build a competing product, or copy its features or interface for that purpose.
5. Plans, payment and limits
Some features need a paid plan. Each plan describes what it includes and its usage limits; when a limit is reached, the feature it covers stops or, where the plan says so, further use is charged.
Paid plans are billed in advance for each billing period through our payment processor, and renew automatically until cancelled. You can cancel at any time; the plan then runs to the end of the period already paid. Prices exclude taxes unless stated. Except where the law requires otherwise, payments are not refundable.
We may change a plan's price or contents. A change to a paid plan you are on takes effect at your next renewal, after notice.
6. The assistant
The Service includes an AI assistant that answers from your workspace's data. Its answers are generated by a machine learning model and can be incomplete or wrong. Review them before you act on them; you are responsible for how you use them. What the assistant uses counts toward your plan's limits.
7. Our service
The Service, its software and its design belong to us and our licensors. These Terms give you the right to use the Service while you have an account, and no other right in it. If you send us feedback, we may use it without obligation to you.
8. Suspension and ending
You can stop using the Service and ask us to delete your account at any time.
We may suspend or end your access if you break these Terms, if your use puts the Service or other users at risk, or if the law requires it. Where we reasonably can, we will tell you first and give you a chance to put things right. When an account or workspace ends, we delete Your Content as described in our Privacy Policy.
9. Changes
The Service will change: features are added, changed and sometimes removed. We may also update these Terms. Each version is dated at the top of this page, and we will give you notice of a material change before it takes effect. If you keep using the Service after a change takes effect, the updated Terms apply.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and we do not promise the Service will be uninterrupted, error-free or secure.
11. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim arising from the Service or these Terms is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars.
Nothing in these Terms limits liability that cannot be limited by law.
12. Governing law
These Terms are governed by the laws of [Governing law], without regard to its conflict-of-laws rules. The courts of [Courts (venue)] have exclusive jurisdiction over any dispute arising from them or from the Service, except that either of us may seek urgent relief to protect its rights in any court that has jurisdiction.
